Overview
Luxembourg's criminal record is called the extrait de casier judiciaire. It is managed by the Criminal Records Department (Service du casier judiciaire) at the Cité judiciaire in Luxembourg City. Extracts are issued free of charge to natural persons and are available online via MyGuichet.lu (with LuxTrust or eID authentication) as a PDF with a GouvCheck QR code for real-time authenticity verification, or in person at the Criminal Records Department counter, or by post. Three types of extract are available: no. 3 (standard), no. 4 (includes driving bans and related sentences), and no. 5 (protection of minors — required for professions involving regular contact with children). For immigration purposes — specifically the application for a temporary authorisation to stay — the General Department of Immigration requires an extract from the criminal record of the applicant's country of legal residence (not the Luxembourg casier judiciaire). Because non-Luxembourg residents' Luxembourg casier judiciaires only record Luxembourg convictions, a foreign criminal record or sworn affidavit must be obtained from the home country. If the role involves regular contact with minors (teaching, childcare, youth sport, healthcare involving children), you must request no. 5 — the 'Protection of minors' extract. Employers are required to specify the required record number in their job advertisement and employment contract. If in doubt, ask your employer which number they need before applying.
For my Luxembourg residence permit application, do I need a Luxembourg or a home-country criminal record?
You need a criminal record extract (or sworn affidavit) from your country of legal residence — not the Luxembourg casier judiciaire. This is because you are typically applying from abroad, before you have resided in Luxembourg. The General Department of Immigration uses this document to assess your public-order and safety profile. If you are already legally residing in Luxembourg for other reasons, you would need the Luxembourg casier judiciaire. If your home country is a Hague Convention party, apostille the extract before submitting; if it is an EU member state, no apostille is needed under EU Regulation 2016/1191.
How long is a Luxembourg criminal record extract valid for official use?
The guichet.public.lu procedure pages do not specify an expiry period for the casier judiciaire extract itself — validity depends on the requesting authority's rules. For immigration purposes, the General Department of Immigration generally requires the extract to be recent (typically issued within 3–6 months of the application submission date). For employment purposes, employers set their own recency requirements. For professional licensing applications to regulators (e.g. the Ministry of Health for healthcare professions), check the specific regulator's requirements. Obtain the extract as close to your application date as possible.
Can my employer request my criminal record extract on my behalf?
Only with your explicit consent. Third parties can apply for a criminal record extract of a natural person by providing: a signed power of attorney from the person concerned; and a legible copy of the concerned person's identity document. The extract is sent to the concerned person's registered address (not the employer's address) — the employer cannot have it sent directly to them unless the person has specifically authorised collection in person with a written power of attorney at the Criminal Records Department. For the 'Protection of minors' extract (no. 5), the applicant must request it themselves.
My home country does not have a formal criminal records system. What can I submit for the Luxembourg immigration application?
Where a criminal record from the country of legal residence is not obtainable — for example, because the country does not maintain a formal criminal records register — the General Department of Immigration accepts a sworn declaration (déclaration sur l'honneur / affidavit) established in the country of legal residence. This sworn statement must be notarised or otherwise officially certified according to the legal conventions in force between Luxembourg and that country, and apostilled or legalised as appropriate.
