1. About these Terms

These Terms of Service (“Terms”) govern your access to and use of the Migration Protect website at migrationprotect.com (the “Site”), the Migration Protect member platform and dashboard (the “Platform”), and any related services (collectively, the “Services”) operated by The Paper Planes Group LLC (“Migration Protect”, “we”, “our” or “us”), a company registered in Delaware, United States of America with registered office at 16192 Coastal Highway, Lewes, Delaware, 19958.

By creating an account, applying for a membership, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years old to create an account or apply for a paid membership. By using the Services you confirm that all information you provide is accurate, that you have the legal capacity to enter into this agreement, and that your use of the Services does not breach any law applicable to you.

3. The Services we provide

Migration Protect provides:

  • Educational content, guides, checklists, articles and videos about international migration, residency and citizenship.
  • A personalised migration pathway tool (“MAYA” / the Migration Assistant) that organises tasks, reminders and resources based on the destination, visa type, family situation and timeline you provide.
  • Access, where included with your membership tier, to the Migration Fee Protection Guarantee (the “Guarantee”) described in Section 9.
  • Referrals to independent third-party migration agents, lawyers and specialists (“Partners”) who provide qualified advice and services on their own account.

Migration Protect is an education, organisation and protection-benefit platform. We are not a migration agent, immigration lawyer, or financial adviser. Nothing we publish or generate within the Services constitutes legal, financial, immigration or migration advice. You should seek advice from a qualified professional regulated in the relevant jurisdiction before making any decision.

4. Your account

When you register, you must provide accurate and complete information and keep it up to date. You are responsible for all activity that occurs under your account. You must keep your password confidential and notify us immediately of any unauthorised use of your account.

We may suspend or terminate your account if we reasonably believe you have breached these Terms, provided false information, attempted to circumvent payment, or used the Services in a way that creates risk for us or other members.

5. Memberships, application and billing

Migration Protect offers a free membership tier and several paid annual memberships (Basic, Essential, Premium, and RCBI). The features and Guarantee coverage included in each tier are described on the /join/ page on the Site and form part of these Terms.

Membership is by application and approval. You apply for membership by completing the sign-up flow on the Site (and, for paid tiers, by paying the applicable membership fee). You become a Member of Migration Protect only when we accept your application and confirm your membership in writing (which may include email confirmation or activation in your account dashboard). Until your application has been approved, you have no rights as a Member, including no entitlement to the Guarantee, MAYA, the personalised roadmap, or any other paid-tier benefit. We may decline an application at our discretion, including (without limitation) where information you have provided is inaccurate, incomplete or misleading, or where we have reasonable grounds to believe approval would expose us, our Partners or other Members to risk. If we decline your application, we will refund any membership fee already collected.

Paid memberships are billed annually in advance. All prices are shown in United States Dollars (USD) unless stated otherwise, and exclude any sales tax, VAT or similar taxes that may apply in your jurisdiction.

Memberships renew automatically each year on the anniversary of your start date, at the then-current price, unless you cancel before the renewal date. We will provide reasonable notice of any material price change before it takes effect.

You can cancel your membership at any time from your account dashboard or by contacting us. If you cancel, your membership remains active until the end of the current billing period; you will not be charged for the next period. Cancellation does not retroactively refund the current period unless required by consumer law in your jurisdiction.

6. Nature of membership — no ownership, no voting rights

Migration Protect membership is a personal, non-transferable contractual right to access the Services described in these Terms for the duration of your membership. It is granted to you, and you alone, by The Paper Planes Group LLC. Membership is not, and shall not be construed as, any of the following:

  • any form of ownership, equity, share, stockholding, partnership, joint venture, or proprietary interest in The Paper Planes Group LLC, Migration Protect, the Site, the Platform, the Guarantee, the Guarantee reserves, the MAYA tool, or any associated assets, intellectual property, revenue, brand or goodwill;
  • any form of voting, governance, control, supervisory, or decision-making right in relation to The Paper Planes Group LLC or any of its affiliates, including any right to vote on company matters, appoint or remove directors or officers, approve corporate actions, or call or attend meetings of the company;
  • any form of profit-share, dividend, distribution, surplus, rebate, royalty, or financial return from The Paper Planes Group LLC or any associated entity;
  • any form of mutual, co-operative, friendly society, or member-owned arrangement, and no member shall be entitled to share in any surplus or assets of The Paper Planes Group LLC on a winding up, sale, restructure, or otherwise;
  • any beneficial interest, trust, or fiduciary interest in any reserves, funds, escrow accounts, bank accounts, or other assets held by The Paper Planes Group LLC in connection with the Guarantee or otherwise. Any reserves or funds held for the purpose of the Guarantee remain the sole property of The Paper Planes Group LLC at all times; members hold a contractual right to claim reimbursement under the Guarantee Wording only, and have no proprietary, beneficial or trust interest in those funds;
  • any security, financial instrument, or regulated investment under the laws of any jurisdiction.

You acknowledge that all rights, title, and interest in The Paper Planes Group LLC, the Site, the Platform, the Guarantee, the Guarantee Wording, the MAYA tool, and all related intellectual property, brand assets, content and data, are and remain at all times the exclusive property of The Paper Planes Group LLC and its licensors. Membership confers a personal, non-transferable, revocable right of access only. You may not transfer, assign, pledge, charge, sublicense, or grant any interest in your membership to any third party without our prior written consent.

Any statement, communication, or marketing that suggests, implies, or could reasonably be construed as conferring on Members any ownership, voting, governance, financial return, or proprietary interest of any kind in The Paper Planes Group LLC, the Guarantee, or any related asset is expressly disclaimed and superseded by this Section 6.

7. Refunds

Where required by law (for example under the EU Consumer Rights Directive or equivalent legislation in your jurisdiction), you have a statutory right to cancel a new paid membership within 14 days of the purchase date and receive a refund of the membership fee. 8. Acceptable use

You agree not to:

  • Use the Services for any unlawful, harmful, deceptive or fraudulent purpose.
  • Republish, redistribute, sell, sublicense or commercially exploit any content available through the Services, except as expressly permitted by us in writing.
  • Use automated tools (including scrapers, crawlers or bots) to access or extract material from the Services, other than search-engine crawlers operating in accordance with our robots.txt.
  • Upload or transmit malware, viruses, or any code intended to disrupt or compromise the Services.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Services to harass, abuse, defame or threaten other members, our staff or our Partners.

9. The Migration Fee Protection Guarantee

IMPORTANT: The Migration Fee Protection Guarantee is a membership benefit, not an insurance product. It is provided as part of your Migration Protect membership and does not constitute insurance, financial, legal or immigration advice.

Eligibility for the Guarantee is restricted. The Guarantee is available only to Members who (i) have had their membership application approved by us under Section 5; and (ii) hold a paid membership tier that expressly includes the Guarantee as a benefit, and have paid the applicable membership fee in full. Members on the free tier, Members whose application has not yet been approved, and Members on paid tiers that do not include the Guarantee have no entitlement to the Guarantee and no right to make a claim under it. Eligibility for the Guarantee begins on the date your paid membership is approved and activated, and continues for the duration of that paid membership, subject to the Guarantee Wording.

Members who satisfy the eligibility conditions above are entitled, subject to the conditions set out in the separate Migration Fee Protection Guarantee Wording (the “Guarantee Wording”), to reimbursement of certain migration-related fees if their visa, residency or citizenship application is unable to proceed for a covered reason. The Guarantee Wording forms part of these Terms and is available on the Site.

Cover amounts, per-category caps, eligibility criteria, claim procedures and exclusions are set out in the Guarantee Wording. In the event of any conflict between these Terms and the Guarantee Wording, the Guarantee Wording prevails in relation to the Guarantee.

Qualifying period. The Guarantee includes a standard 30-day qualifying period, in line with industry practice. Trigger events that occur within the first 30 days after the date you first pay for a membership tier that includes the Guarantee are not claimable; reimbursement is available only for trigger events occurring 31 days or more after that date. The qualifying period applies once to your first paid membership period and does not apply again on renewal. If you upgrade to a higher tier, the increase in your guarantee amount is subject to a further 30-day qualifying period from the date of the upgrade; your previous guarantee amount continues to apply during that period. Full details are set out in the Guarantee Wording, which prevails in the event of any conflict.

Claims must be notified to us no later than 31 days after the event giving rise to the claim — notify us first even if your supporting evidence is not yet complete, and we will send you the appropriate document checklist. Late notifications may be refused at our discretion.

10. Third-party Partners

Migration Protect refers members to independent third-party Partners (including registered migration agents, immigration lawyers, and specialist service providers). Partners operate on their own account; we are not a party to any contract you enter into with them, and we do not provide any advice given by them. Any fees, terms, and outcomes arising from your engagement with a Partner are between you and that Partner.

We take reasonable care in selecting Partners but do not warrant the suitability, accuracy or outcome of any advice or service they provide. If a Partner provides advice that is incorrect or inadequate, your remedies are governed by your agreement with that Partner and (where applicable) the Guarantee.

We may receive a commission, referral fee, or other compensation from Partners when you engage their services through our referral, whether or not the engagement is documented through our website. By using the Services, you acknowledge and accept this arrangement. You agree that our entitlement to such compensation does not give rise to any dispute, claim, or right of action against us, and is not a basis on which to challenge or invalidate any referral, recommendation, or service you receive.

11. Intellectual property

All content made available through the Services — including text, articles, guides, checklists, videos, the MAYA tool, the pathway templates, and the look and feel of the Site — is owned by Migration Protect or its licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial migration journey. This licence ends automatically when your membership ends.

12. Content you submit

You retain ownership of any content you submit through the Services (including pathway data, profile information, forum posts and messages to us). By submitting content, you grant us a worldwide, royalty-free licence to host, store, reproduce and use that content to operate, improve and promote the Services. You are responsible for ensuring that any content you submit does not infringe the rights of others.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any information provided through the Services is complete, accurate or up to date for your particular circumstances.

Migration rules change frequently and differ between jurisdictions. You must verify any information that materially affects your decisions with a qualified professional before acting on it.

14. Limitation of liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to the paragraph above, our total aggregate liability to you in any 12-month period, arising under or in connection with these Terms, the Services or your membership, is limited to the greater of (a) the total membership fees paid by you in that 12-month period; and (b) the maximum aggregate cover amount applicable to your paid membership tier under the Guarantee Wording (paid in full), subject to the per-category sub-limits set out in the Guarantee Wording. For the avoidance of doubt, the Guarantee operates on its own terms and the cover amounts set out in the Guarantee Wording apply in addition to, and are not capped by, this clause.

We are not liable for any loss arising from a government decision, a change in immigration policy, a Partner’s advice, or any other matter outside our reasonable control.

15. Indemnity

You agree to indemnify and hold Migration Protect and its officers, employees and agents harmless from any claim or demand (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.

16. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give you reasonable notice (for example by email, by a notice on the Site, or both) before the change takes effect. Your continued use of the Services after the change takes effect constitutes acceptance of the updated Terms.

17. Termination

Either party may end this agreement: you, by closing your account; us, by terminating your access if you breach these Terms or where we discontinue the Services. Sections that by their nature should survive termination (including those relating to membership, the Guarantee, intellectual property, disclaimers, limitation of liability and dispute resolution) will continue to apply.

18. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws principles. The courts of the State of Delaware have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any non-waivable consumer protection rights you have in your country of residence.
