Seven reasons we'll reimburse fees.
If your migration does not go ahead for any of the following reasons, we will reimburse certain non-refundable fees which you have paid — subject to the Guarantee Wording.
Government rejection of a valid application
If you have applied for a valid visa, residency or citizenship and it is subsequently rejected by the relevant government authority, and the fees and charges paid by you are not refundable, you may claim reimbursement for costs associated with pursuing an appeal.
Serious illness, injury or death of a close relative
If you are unable to complete your application or activate your visa within the specified timeframe as a direct result of the serious illness, serious injury, or death of a close relative, and this alters your application or your decision to remain in your country of embarkation.
Serious illness or injury of you or a named member
If you or any member named on your visa or citizenship application are unable to complete the application within the specified timeframe as a direct and necessary result of serious illness, serious injury, or death of a close relative, or any other illness described in legislation for the host country.
Diagnosis of a preventing medical condition
If you are unable to complete your application or you become aware that a previously undiagnosed medical condition would prevent you or your close family from further applying for a valid visa, residency or citizenship.
Changes to government immigration legislation or policy
If you have previously been eligible and commenced your application but discover you are unable to successfully complete it due to non-forecasted changes to government legislative instruments — including changes to visa classes, eligibility criteria, skilled occupation lists, or testing standards.
Incorrect or inadequate professional advice
If you have received incorrect or inadequate advice from a registered migration agent, solicitor, or migration practitioner, and as a consequence you are ineligible for a visa — including incorrect visa class applied for, wrong employment category, failure to lodge in time, or failure to pay correct fees.
Failure of a sponsor to meet obligations
If you are applying for a visa that requires sponsorship and the sponsor fails to meet the obligations required by the regulatory authority — such as failing to provide employment documentation, or not being eligible to act as a sponsor.
Reimbursable fee limits by membership level.
The table below shows the maximum reimbursement amount for each fee category at each membership level. Both the per-category limit and the overall tier maximum apply — the lower of the two governs any individual claim.

1 About RCBI Premium: residency- and citizenship-by-investment applications don't typically require skills assessments, language tests, visa medicals or police character testing in the same form as skilled-migration pathways. The RCBI Guarantee focuses on the categories where investment migrants do incur substantial fees — government application charges and appeal-related legal costs — with higher sub-limits to reflect the more complex legal work involved.
Per-category and overall caps work together. A claim is capped by both the per-category figure in the table above and the overall tier maximum. You can claim across multiple categories in a single event, but the total cannot exceed your tier's overall cap.

Why we set eligibility criteria.
The Migration Fee Protection Guarantee is designed for people pursuing visas, residency or citizenship through standard legal pathways. The eligibility criteria above keep the Guarantee aligned with that purpose and consistent with the obligations we take on under the Guarantee Wording.
If you're applying for asylum or claiming refugee status, the protections, fees and processes that apply to your situation are governed by separate humanitarian frameworks — not by the standard visa process the Guarantee is built around. We point asylum seekers and refugees to the appropriate national and UNHCR resources rather than offering a product that isn't designed for those cases.
Full eligibility criteria, definitions and exclusions are set out in the Migration Fee Protection Guarantee Wording — the definitive document.
